Waver and Release

In consideration for Participant’s voluntary participation in the SV Outlaws Water Polo program, and related events and activities, Participant hereby releases, waives liability, discharges, holds harmless, indemnifies and covenants not to sue SV Outlaws, any of its coaches, owners, members, volunteers, administrators, managers, trainers, sponsors, contractors, agents, instructors, employees, officers or directors and their successors, heirs and assigns (“SV Outlaws and SV Outlaws Staff”), any tournaments, their associated directors, administrators officers managers, or sponsors, any owners or lessees of premises, municipalities, governmental agencies and their successors, heirs and assigns (“SV Outlaws Program and Related Parties”) for any and all present and future claims or liability incurred as a result of my participation in the SV Outlaws Water Polo program, activities incidental thereto, wherever, whenever or however same may occur, including without limitation for any property damage, personal injury or wrongful death, and Image use. Participant understands and acknowledges that:

Water Polo is a vigorous, physical contact team sport that at times involves the risk of injury, including without limitation, severe cardiovascular stress, death, serious neck and spinal injuries resulting in complete or partial paralysis, brain damage, concussion, injury to virtually all bones, joints, muscles and internal organs.
Participant is assuming all risks and hazards associated with participation in the sport and with the SV Outlaws Water Polo program, including without limitation, unforeseen consequences, including those which may be due to the unavailability of immediate emergency medical care.
Participant must be in proper physical condition to participate in the SV Outlaws Water Polo program and have no illness, disease or existing injury or physical defect that would be aggravated by such participation. Participant will immediately inform SV Outlaws and the SV Outlaws coach for Participant’s team if this status changes.
At all times Participant must have a current medical consent/release (filled during registration process) on file with SV Outlaws.
SV Outlaws does not have personal injury insurance that covers my participation, therefore Participant should have a current, active, personal injury insurance policy in force, which covers my participation.
Participation in the SV Outlaws Water Polo program may involve activities incidental thereto, including without limitation, travel to and from pool sites or other events with SV Outlaws or SV Outlaws Staff. Such travel may include without limitation, car, van, bus or similar travel, air travel, hotel stays, sharing of room accommodations with other SV Outlaws Staff or participants. Participant is responsible for all travel and travel-related expenses. Participation at games or other events and activities may be at sites that are remote from available medical assistance and there may be possible reckless conduct from other participants. Participant is voluntarily participating in these activities with full knowledge of the possible risks and dangers involved and Participant hereby accepts full responsibility for any and all inherent risks associated therewith.
SV Outlaws is not responsible for any property loss at any time.
Participant has the right and responsibility to inspect the equipment and facilities prior to events and, if Participant believes that anything may be unsafe, Participant will advise the coach of the condition and may refuse to participate. Participation assumes consent to use of the equipment or the facility.
Participant player status must be kept in good standing at all times. Participant will not conduct themselves in such a way as to do harm or in any way disparage SV Outlaws, SV Outlaws Staff, SV Outlaws Program or Related Parties.
Participant may be dismissed from participation, lack of payment of any amounts due, conduct that in the sole discretion of SV Outlaws is inappropriate or unsportsmanlike behavior on or off the field of play.
Any participation in other clubs (ie San Jose Water Polo Foundation) is voluntary and is outside of the SV Outlaws Water Polo program. SV Outlaws will have no liability or responsibility for activities relating to participation with other clubs.
I may provide SV Outlaws with personal information and am hereby authorizing use of the personal information as needed by the Club to register my child and to procure player roster cards, tournament registrations, submit financial aid applications, and other related activities associated with participant playing with the Club during this season. I understand that I should use efforts to send any personal information encrypted when I can and that the Club will be transmitting such personal information electronically and through e-mail as needed to communicate the information for the individuals within the Club who need to process such information.

Participant hereby voluntarily waives any and all claims that may be made by Participant, my family, my child, my estate, my heirs or assigns resulting from ordinary negligence, both present and future and agree to release and forever discharge SV Outlaws, SV Outlaws Staff, SV Outlaws Program and Related Parties from any and all liabilities, claims, actions, damages, costs or expenses of any nature whatsoever, whether in law or equity, known or unknown, that any of the undersigned ever had, now has or hereafter can, shall or may have against any of the SV Outlaws, SV Outlaws Staff, SV Outlaws Program and Related Parties arising out of or in any way related, directly or indirectly, to my participation within the SV Outlaws Water Polo program and related events and activities.

Participant has completely read this document and fully understand its contents. Participant acknowledges that Participant has given up substantial rights by accepting this document and that Participant does so voluntarily. For those individuals under the age of eighteen (18) years (minor), as the parent and natural guardian or legal guardian of the Participant, I hereby agree to the foregoing terms for, and on behalf of, the Participant I am registering. I hereby bind myself, the Participant, and all other assigns to the terms set forth above. I represent and certify that I have the legal capacity and the authority to act for, and on behalf of, the Participant in the acceptance of this document.
